UW-Madison Internal ADA Accommodation Requests and Appeal/Grievance Procedures

SUMMARY

  1. EMPLOYEES

    1. INDIVIDUAL REQUESTS FOR ACCOMMODATION(S)
      All employee requests for individual disability accommodation(s) are made under the appropriate employee disability accommodation policy or to the Office of Affirmative Action and Compliance (OAAC) Personnel and Disability Specialist when the employee is not covered by one of the policies. Those policies currently in place include the faculty "Interim Review Policy, Requests for Accommodation under ADA," The "UW-Madison Academic Staff Disability Accommodation Policy," and the "Disability Accommodation Policy for Classified Employees."

    2. APPEAL/GRIEVANCE

      1. FACULTY

        1. If an individual faculty member's request for an accommodation is denied or the accommodation proposed is not deemed reasonable by the faculty member, the faculty member may appeal by filing a grievance with the University Committee under Faculty Policies and Procedures (FPP) 8.15B, as provided for in the faculty "Interim Review Policy, Requests for Accommodation under ADA."

        2. A faculty member who has a complaint of any violation of Title II of the ADA, unrelated to a request for an accommodation, may, as appropriate, (i) pursue a grievance under FPP 8.15, or (ii) pursue a discrimination complaint with OAAC.

      2. ACADEMIC STAFF

        1. If an academic staff member's request for an accommodation is denied or the academic staff member disagrees with the initial decision, the academic staff member may file an appeal, as provided for in the "UW-Madison Academic Staff Disability Accommodation Policy" at Section VII.

        2. An academic staff member who has a complaint of any violation of Title II of the ADA, unrelated to a request for an accommodation, may, as appropriate, (i) pursue a grievance under Academic Staff Policies and Procedures (ASPP) Chapter 7, or (ii) pursue a discrimination complaint with OAAC.

      3. CLASSIFIED EMPLOYEES

        1. If a classified employee's request for an accommodation is denied or the employee disagrees with the initial decision, the employee may file an appeal as provided for in the "Disability Accommodation Policy for Classified Employees" at Section V.

        2. A classified employee who has a complaint of any violation of Title II of the ADA, unrelated to a request for an accommodation, may, as appropriate, (i) pursue a grievance or complaint under the applicable collective bargaining agreement or other classified employee policies and procedures, or (ii) pursue a discrimination complaint with OAAC.

      4. OTHER EMPLOYEES
        Employees not included in any of the above classifications or covered by the above described appeal or grievance policies or procedures may file an appeal or complaint with the ADA Coordinator (ADAC). The ADAC will determine whether to refer it to one of the existing procedures for handling appeals regarding an individual's request for an accommodation, or to handle it as a complaint filed under the "ADA Grievance Procedure."



  2. STUDENTS

    1. INDIVIDUAL REQUESTS FOR ACCOMMODATION(S)
      Student requests for individual accommodation(s) may be made to the McBurney Disability Resource Center (McBurney), a designated unit disability liaison such as an appointed Access and Accommodation Resource Coordinator (AARC), or to an individual faculty member in whose class the accommodation is desired.

    2. APPEAL/GRIEVANCE

      1. When the subject is the denial or alleged inappropriate modification of a requested accommodation, a student may file an appeal under the "Interim Student Disability Accommodation Requests Appeal Process."

      2. When the subject is an alleged violation of Title II of the ADA, unrelated to the denial of an accommodation request, a student may, as appropriate, (i) pursue a grievance or complaint under any existing available school, college or unit procedure, or (ii) file a discrimination complaint under Section 36.12, Wis. Stats., with OAAC.



  3. APPLICANTS AND OTHERS

    1. INDIVIDUAL REQUESTS FOR ACCOMMODATION(S)

      1. Applicants for Positions
        Applicants for academic staff or classified positions may make requests for individual disability accommodations under the "UW-Madison Academic Staff Disability Accommodation Policy" (Section III.A.), or the "Disability Accommodation Policy for Classified Employees" (Section III.A.), respectively. Applicants for faculty positions should contact the appropriate department chair or the Personnel and Disability Specialist in OAAC.

      2. Others
        Requests for individual disability accommodations by visitors, program participants and others who are not covered by any of the provisions set out above may be made to McBurney or to an appropriately designated individual in the department or unit being asked to provide the accommodation(s).

    2. APPEAL/GRIEVANCE

      1. Applicants for Positions <0l type=a>

      2. If an applicant's request for an accommodation is denied or the applicant disagrees with the initial decision, the applicant may file an appeal a complaint with the appropriate external agency (i.e., Wisconsin Personnel Commission, federal Equal Employment Opportunity Commission).

      3. An applicant who has a complaint of any violation of Title II of the ADA, unrelated to a request for an accommodation, may file a complaint under the "UW-Madison Grievance Procedure."

    3. Others
      Visitors, program participants and others not covered by any of the provisions set out above may file a complaint with the ADAC under the "UW-Madison ADA Grievance Procedure" regarding denials of individual accommodations or about any alleged violation of Title II of the ADA.

Copies of the various policies, procedures and other documents mentioned above are available from the Office of Human Resources, the Classified Personnel Office, the Office of Affirmative Action and Compliance, the Dean of Students Office, the McBurney Disability Resource Center, the Secretary of the Faculty, the Secretary of the Academic Staff, designated ADA Division Level Representatives (DLRs) and Access and Accommodation Resource Coordinators (AARCs), and the ADAC. They will also be available electronically on WiscINFO.
